You are granted a limited, non-exclusive, non-transferable license to access and use the Services for personal, non-commercial purposes, subject to these Terms.

User-Generated Content

By submitting or posting any user-generated content on our platform, you grant us a non-exclusive, royalty-free, perpetual, irrevocable, and sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media. You represent and warrant that you have all necessary rights to grant the licenses described in this section.

Payments, Refunds, and Cancellations

To access certain features of the Services, you may be required to pay a fee. All payments are due upon receipt.

a) Refund Policy:

We offer a 30-day refund policy, subject to the following terms:

i. To be eligible for a refund, you must provide proof that you have completed the course and not seen results. This includes screenshots of your course progression, evidence that you submitted assignments to the Assignments Avenue tab within the course, and records of your active engagement with questions and participation in the community.ii. Refund requests must be submitted within 30 days of the date of purchase.iii. Refunds will be processed within a reasonable time after receiving and verifying the required documentation. All refunds are subject to our sole discretion and will be granted only if the eligibility criteria are met.

b) Cancellations:

No refunds will be issued for cancellations. However, users who cancel their subscription will continue to have access to the course and community platform until the end of the month of their current membership.

In case of any disputes regarding refunds or cancellations, our decision shall be final and binding.

Support

We are committed to providing our members with exceptional support to enhance their experience with our Services. If a member requires assistance or has a support query, they can submit a support ticket through our designated support system. Upon receipt of a support ticket, one of our dedicated staff members will promptly address the inquiry and provide the necessary assistance.

Termination

We reserve the right to terminate your access to the Services at any time and for any reason, with or without notice, including but not limited to your violation of these Terms or failure to pay applicable fees.

Disclaimer of Warranties

The Services are provided "as is" without any warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Services will be error-free, uninterrupted, or secure.

Limitation of Liability

In no event shall we be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Services, even if we have been advised of the possibility of such damages. Our total liability for any direct damages arising from your use of the Services shall not exceed the total amount paid by you for the Services during the six (6) months immediately preceding the event giving rise to such liability.

You agree to indemnify, defend, and hold harmless DIGITAL SALES NOMAD LLP, its affiliates, and their respective officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, or expenses, including reasonable attorneys' fees and costs, arising out of or in any way connected with your access to, use of, or violation of these Terms or the Services.

We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. Success Stories and Testimonials

By participating in our online course and community, you grant us the right to use your success stories, testimonials, and achievements that you share within the community for promotional purposes. This may include, but is not limited to, sharing on our website, social media platforms, or in marketing materials. When using your success stories or testimonials, we may:

a) Use your name, image, and relevant information about your achievements, while ensuring that any private or sensitive information remains confidential.b) Edit, modify, or create derivative works from your success stories or testimonials, as long as the changes do not materially alter the original content or context.

You represent and warrant that you have the necessary rights and authority to grant us the permission to use your success stories, testimonials, and achievements as described above. You also acknowledge and agree that you will not be entitled to any compensation for our use of your success stories or testimonials. We will make reasonable efforts to comply with your request, subject to applicable laws and regulations.

By sharing your success stories, testimonials, and achievements in the community, you acknowledge and agree to these terms.

These Terms and any dispute arising out of or in connection with the Services shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts located in London, UK to resolve any legal matter arising from these Terms or your use of the Services.

Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, such provision shall be deemed severed from the remaining provisions and shall not affect the validity and enforceability of the remaining provisions.
